Doctors in the UK who chose membership of the MDU, MPS or MDDUS are buying 'Discretionary' Indemnity, not Insurance. Discretionary Indemnity affords no legal right to assistance should a member require it. Most doctors reliant on Discretionary Indemnity mistakenly believe they are insured, when they have no guarantee of indemnity, only the right to have your request considered reasonably.

The MDU, MPS and MDDUS can and do exercise their discretion and do refuse indemnity to doctors. Given the choice, most would not insure their business or personal belongings on this basis, so why settle for this when it comes to clinical negligence cover?

We find it hard to believe that Discretionary Indemnity is still allowed in the UK. In Australia, for example, discretionary indemnity was abolished in 2003. Britain is one of the few remaining EU member states that still allows Discretionary Indemnity for healthcare professionals.

We maintain that doctors and patients should have the reassurance of a contractual guarantee of indemnity for clinical negligence claims, which only an Insurance policy can offer.
